1. Agreement to Terms
By downloading or using Planomark, you agree to be bound by this End User License Agreement ("EULA"). If you do not agree, do not download or use the app.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Planomark on devices you own or control, solely for your personal or professional use.
3. Subscription and Purchases
Planomark is free to download. Certain features require a paid subscription or one-time purchase:
- Free plan: Limited number of surveys and reports.
- Premium plan: Unlimited surveys and reports, available as a monthly or annual subscription.
Subscription fees are billed through the Apple App Store or Google Play and renew automatically unless cancelled at least 24 hours before the end of the current period. You can cancel at any time through your App Store or Play Store account settings.
Subscription fees may change at our discretion. We will provide reasonable notice of any price changes.
4. Use Restrictions
You may not:
- Copy, modify, or distribute the app or its content.
- Reverse engineer or attempt to extract the source code.
- Use the app for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the app or its infrastructure.
5. Your Content
You retain full ownership of all documents, photos, and reports you create with Planomark. All data is stored locally on your device. We do not access, upload, or claim any rights over your content.
6. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR SPECIFIC REQUIREMENTS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIVE DOLLARS ($5), WHICHEVER IS GREATER.
8. Indemnification
You agree to defend and hold harmless Planomark and its developers from any claims, damages, or expenses arising from your use of the app or your violation of this EULA.
9. Modifications to This EULA
We may update this EULA from time to time. By continuing to use the app after changes are posted, you agree to be bound by the modified EULA. We will update the "Last Updated" date to reflect changes.
10. Governing Law
This EULA is governed by the laws of the jurisdiction in which the developer operates, without regard to conflict of law principles.
